TERMS OF USE & EU RIGHT OF WITHDRAWAL WAIVER

This document constitutes a legally binding agreement made between you, whether personally or on behalf of an entity (“User” or “You”), and Andrei Kurylovich, a registered independent professional operating under the commercial and artistic designation Aurora Machina (“Provider”, “We”, “Us”, or “Our”), concerning your access to and use of the educational course platform, downloadable assets, video streams, and associated community channels (collectively, the “School”).
By checking the agreement box at checkout, executing a purchase, or accessing any provided materials within the School, You acknowledge that You have read, understood, and agreed to be bound by all of these Terms, as well as our Privacy Policy. If You do not agree with all of these terms, You are expressly prohibited from using the School, and You must discontinue use immediately.
1. User Eligibility and Account Registration
To enroll in the School, You must be at least the age of digital majority in your jurisdiction (e.g., 16 years old in the European Union, 13 years old in the United States). If You are under 18 years of age (or the legal age of majority where you reside), You may only purchase Course Materials and access the School with the explicit involvement, consent, and supervision of a parent or legal guardian who agrees to be bound by these Terms.
2. Definitions and Scope of Agreement
- Course Materials: Refers collectively to all streaming video data, tutorials, written documentation, reference imagery, Photoshop files (.psd), Blender files (.blend), 3D polygonal meshes, source curves, and shaders provided by the Provider within the School.
- Proprietary Designs: Refers specifically to the aesthetic, structural, and mechanical design configurations of the alien mech concept and any related hard-surface components developed by Andrei Kurylovich and showcased within the Course.
- Student Original Work: Refers to independent 2D or 3D artwork generated from a blank digital canvas by the User, utilizing the educational techniques, workflow strategies, and conceptual principles instructed in the School, without incorporating the physical geometry or source files of the Provider.
3. Intellectual Property Rights & Educational License Grant
All Course Materials and Proprietary Designs are the exclusive intellectual property of Andrei Kurylovich and are protected by applicable copyright, trademark, and unfair competition laws of the Federal Republic of Germany, as well as international copyright treaties.
Subject to your compliance with these Terms, We grant You a limited, non-exclusive, non-transferable, revocable, single-user license to access and view the Course Materials solely for your personal, non-commercial, educational utility.
Under this license, You are strictly prohibited from:
- Re-selling, redistributing, mirroring, or sharing access to the Course Materials, in whole or in part, via any public or private digital medium, torrent network, or cloud storage system.
- Utilizing the provided 3D meshes, source files, or Proprietary Designs within any commercial pipeline, including but not limited to indie game development, feature film production, commercial concept art commissions, or freelance client assignments.
- Minting, marketing, or selling any portion of the Course Materials or variations of the Proprietary Designs as Non-Fungible Tokens (NFTs) or digital collectibles.
- Modifying, kitbashing, or adapting the provided 3D assets to sell or pass them off as your own original commercial asset packs.
4. Student Ownership & Portfolio Dissemination
The Provider claims no ownership rights over Student Original Work. You retain 100% of the copyright to your completely original creations and are fully authorized to utilize such work for commercial endeavors, career advancement, and freelance initiatives.
- Attribution Clause: We highly encourage You to share your progress and final results! However, if You reproduce the exact Proprietary Design taught within this course for technical practice and display the resulting images or animations on public portfolio platforms (including but not limited to ArtStation, Instagram, and X), You must explicitly include visible attribution to the source material within the project text description (e.g., “Based on the concept design architecture by Aurora Machina”).
5. Machine Learning & Generative AI Restriction
The User is contractually prohibited from extracting, downloading, ripping, uploading, or processing any portion of the Course Materials—including video recordings, audio tracks, written transcripts, 2D sketches, and 3D files—for the purpose of training, fine-tuning, compiling, or informing machine learning algorithms, artificial intelligence (AI) text-to-image or text-to-3D generation systems, or related synthesis software. This includes explicitly prohibiting the uploading of Course Materials into third-party AI platforms (e.g., ChatGPT, Midjourney, Claude) for summarization, analysis, or generation purposes.
6. Promotional License for Student Submissions
By voluntarily uploading, submitting, or displaying your project outcomes within the official School community boards, chat environments, or by tagging the official social profiles of Aurora Machina, You grant Us a royalty-free, non-exclusive, worldwide license to display, reproduce, and feature your artwork. This right is granted strictly for the purpose of marketing the School, celebrating student achievements, and showcasing course outcomes. We will make reasonable efforts to ensure your corresponding user handle or professional name is credited alongside the work. You may revoke this promotional license at any time by providing written notice to the Provider.
7. Community Conduct and User-Generated Content
The School may include community boards, chat environments, or Discord servers. You agree to use these channels respectfully. You are strictly prohibited from posting content that is unlawful, harassing, defamatory, sexually explicit, or that infringes upon the intellectual property of others. The Provider assumes no liability for content posted by Users. We reserve the right to remove any content or terminate the access of any User who violates these community standards.
8. Anti-Piracy Measures and Credential Security
Access credentials issued for the School are personal and non-transferable. Group buying, account pooling, or credential sharing is strictly monitored. If the Provider identifies systemic indicators of multi-user access from a single account, or un-authorized asset distribution, We reserve the right to suspend or permanently terminate your access to the School for cause in the event of a material breach of this contract. The Provider reserves the right to pursue full statutory damages under intellectual property laws.
9. Pricing and Taxes
All prices for the Course are displayed on the checkout page and are subject to change at the Provider's discretion. Depending on your location, your purchase may be subject to local sales tax or Value Added Tax (VAT), which will be calculated, collected, and remitted according to applicable local laws prior to the completion of your transaction.
Payment Processing: All financial transactions are handled securely by third-party payment gateways (e.g., Teachable Payments, Stripe, PayPal). The Provider does not store or process your raw credit card data and is not liable for any processing errors, unauthorized charges, or platform outages originating from these third-party services. For non-EUR transactions, You are solely responsible for any currency conversion fees or exchange rates applied by your financial institution.
10. Explicit Refund Policy & EU Right of Withdrawal Waiver
Due to the digital infrastructure of the School, providing immediate consumption of streaming material and instant delivery of high-value downloadable digital source files, all transactions are final once the platform content has been accessed.
- For Consumers Residing in the European Union and the Federal Republic of Germany: Pursuant to the German Civil Code for digital content (§ 356 Abs. 5 BGB), by checking the agreement box at checkout and completing this purchase, You explicitly acknowledge and agree that You consent to the immediate execution of this digital services contract before the expiration of the 14-day withdrawal period. By granting this consent, You acknowledge that You lose your statutory right of withdrawal (Widerrufsrecht) once access to the digital content begins. This pre-contractual consent will be confirmed to You on a durable medium (e.g., your order confirmation email).
11. Duration of Access (Platform Lifespan)
Where course enrollment is marketed as "ongoing" or "lifetime" access, this refers specifically to the functional lifespan of the School platform. While We intend to keep the Course Materials available indefinitely, We reserve the right to modify, suspend, or discontinue the School at any time. In the event of a permanent platform closure, We will make reasonable efforts to provide active students with prior notice and an opportunity to download applicable offline assets.
12. Exclusion of Warranties (Provided "As-Is")
The instructional content and digital assets are provided on an "as-is" and "as-available" basis. The Provider makes no guarantees, expressed or implied, regarding the ongoing compatibility of the provided project files with future iterations of third-party software (including Blender, software plug-ins, or operating systems). The Provider does not warrant that the Course Materials are entirely free of typographical or technical discrepancies, nor do We guarantee specific professional employment, financial returns, or career milestones as a consequence of course consumption.
13. Limitation of Liability
You agree to defend, indemnify, and hold harmless Andrei Kurylovich from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, your Prohibited Conduct, or misuse of the Course Materials. To the maximum extent permitted by applicable law, in no event shall the Provider be held liable for any direct, incidental, punitive, or consequential damages resulting from your use or inability to access the School. Nothing in these terms limits the Provider's liability for damages arising from injury to life, body, or health, or for damages caused by intent or gross negligence.
14. Governing Law & Forum Selection
These Terms and your contractual relationship with the Provider shall be governed exclusively by the internal statutory laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- For Business Users (B2B): The exclusive place of jurisdiction for all disputes arising from this contract shall be the competent courts located in Oldenburg, Germany.
- For Consumers (B2C): If You are a consumer residing in the European Union, mandatory statutory consumer protection regulations of your country of residence remain unaffected. You may bring legal proceedings in the competent courts of your place of residence or in Oldenburg, Germany.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify You of material changes via email or an announcement within the School platform. Your continued use of the School following the effective date of any changes constitutes your binding acceptance of the revised Terms.
16. Complete Severability
If any provision or clause of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that specific provision shall be deemed severable and modified to the minimum extent necessary to achieve the original intent. The remaining clauses shall persist in full force and effect.
